This letter responds to applicant’s communication filed on October 2, 2006.  Please note that the Office has reassigned this application to the undersigned trademark examining attorney.

 

Upon further review of this application including the specimen of use, the following requirement is issued:

 

Recitation of Services

 

The wording “testing and evaluation for industrial process analysis and control” in the identification of services needs clarification because the nature of the matter tested is unclear.  Applicant may change this wording to the following, if accurate.  TMEP §1402.01. 

 

Optical computing services for production process control, namely, testing, analysis and evaluation of industrial processes using optical spectroscopy (International Class 42). 

 

Please note that, while the identification of services may be amended to clarify or limit the services, adding to the services or broadening the scope of the services is not permitted.  37 C.F.R. §2.71(a); TMEP §1402.06.  Therefore, applicant may not amend the identification to include services that are not within the scope of the services set forth in the present identification.

Applicant’s Proposed Description of the Mark
