The following were discussed in communication with Steven M. Rabin on June 9, 2006.  Applicant must respond to each refusal and/or requirement raised below.

 

 

 

Identification of Goods:

The wording “computer mainframes, disk drives, network interface cards and personal computer panels” in the identification of goods needs clarification because the wording is indefinite.  TMEP §1402.01. 

 

The applicant may adopt and clarify the following:

 

Class 9:

 

Photocopying machines,

 

Computers,

 

Computer mainframes, namely, (list the common commercial name of the goods),

 

Computer mouse,

 

Central processing units,

 

Computer, digital, floppy and optical disk drives,

 

Televisions,

 

Interface cards for data processing equipment in the form of printed circuits,

 

Printed circuit boards,

 

Blank floppy computer disks,

 

Computer cursor control devices, namely, light pens,

 

Computer printers,

 

Floppy disk drives,

 

Personal computer panels, namely, (list the common commercial name of the goods),

 

Notebook computers,

 

Computer monitors,

 

Compact disk drives,

 

Computer hard disk drives,

 

Computer keyboards.

 

Additions Not Allowed:

 

Please note that, while the identification of goods may be amended to clarify or limit the goods, adding to the goods or broadening the scope of the goods is not permitted.  37 C.F.R. §2.71(a); TMEP §1402.06.  Therefore, applicant may not amend the identification to include goods that are not within the scope of the goods set forth in the present identification.

Applicant must specify whether the mark has any significance in the field or trade or industry, any geographical significance, or any meaning in a foreign language.  37 C.F.R. §2.61(b).
