The Statement of Use filed on March 29, 2007, does not meet the minimum filing requirements and is not accepted for the reason(s) set forth below. Since the time period for filing a statement of use expired on June 26, 2007, the above-identified APPLICATION IS ABANDONED. 37 C.F.R. §2.88.
STATEMENT OF USE IS DEFICIENT AS FOLLOWS:
FEE UNPAID: The required filing fee for the statement of use was not submitted. A filing fee for at least one class of goods and/or services is one of the minimum filing requirements for a statement of use. The filing fee is $100 per class. 15 U.S.C. §1051(d); 37 C.F.R. §§2.6(a)(3) and 2.88(e)(1); TMEP §§1109.01 and 1109.15.
There is no time remaining in the statutory time period for filing a statement of use. Therefore the application is abandoned.
APPLICANT’S OPTIONS: Applicant has the option to (1) file a petition to revive this application under 37 C.F.R. §2.66 before expiration of the two month period after the mailing date of the notice of abandonment (the notice of abandonment will issue shortly after this Office action), or (2) file a new application.
