The assigned Examining attorney has reviewed the referenced application and determined the following.

 

1.  Information:  No Similar Marks

The Office records have been searched and no similar registered or pending mark has been found that would bar registration under Trademark Act Section 2(d), 15 U.S.C. §1052(d).  TMEP §704.02. 

 

The applicant must respond to the following requirements.

 

 

2.  Requirement:  Clarify Identification of Goods   

Applicant must clarify the identification of goods to specify the common commercial or generic name for the goods.  If there is no common commercial or generic name, then applicant must describe the product and intended consumer as well as its main purpose and intended uses.  Applicant may adopt the following identification of goods, if accurate:  Hair care and hair styling preparations, namely, shampoos, conditioners, sculpting lotions, sculpting foams, styling gels and sprays, and waving and setting lotions, in International Class 3.  TMEP § 1402.01.

Please note that, while the identification of goods and/or services may be amended to clarify or limit the goods and/or services, adding to the goods and/or services or broadening the scope of the goods and/or services is not permitted.  37 C.F.R. §2.71(a); TMEP §1402.06.  Therefore, applicant may not amend the identification to include goods and/or services that are not within the scope of the goods and/or services set forth in the present identification.

 

3.  Requirement: Standard Character Claim

The Applicant has not submitted a claim for a standard character drawing.  As detailed in Exam Guide No. 1-03 issued October 30, 2003 and effective November 30, 2003, which can be viewed at http://www.gov.uspto.report/web/offices/tac/notices/examguide1-03.htm. 

 

     Applicant must submit the following standard character claim: 

 

“The mark is presented in standard characters without claim to any particular font style, size, or color.”

4.  Requirement:  Disclaimer

Applicant must insert a disclaimer of “FREE SHAMPOO” in the application because the wording is descriptive of a feature of applicant’s goods.  See attached websites showing the wording FREE used in combination with SHAMPOO to describe products free of undesirable ingredients, and applicant’s own identification of goods and/or services.  Trademark Act Section 6, 15 U.S.C. §1056; TMEP §1213.

 

The computerized printing format for the Office’s Trademark Official Gazette requires a standardized format for a disclaimer.  TMEP §1213.08(a)(i).  The following is the standard format used by the Office:

 

No claim is made to the exclusive right to use “FREE SHAMPOO” apart from the mark as shown.
