The assigned trademark examining attorney has reviewed the referenced application and has determined the following:

 

No Conflicting Marks Noted

The Office records have been searched and no similar registered or pending mark has been found that would bar registration under Trademark Act Section 2(d), 15 U.S.C. §1052(d).  TMEP §704.02.

 

Identification of Goods

The wording “banners” and “key chains” used to describe the goods needs clarification because it does not specify the material composition of the goods.  Specifically, “paper banners” are Class 16 goods, “plastic banners” are Class 20 goods, “cloth banners” are Class 24 goods, “metal key chains” are Class 6 goods, “leather key chains” are Class 18 goods, and “non-metal and non-leather key chains” are Class 20 goods.  In addition, the remainder of the applicant’s identification combines together goods from numerous different classes.  The applicant must amend the identification to clearly identify all of the goods and to properly classify all of the goods.  TMEP §1402.01.  Applicant may adopt the following identification of goods, if accurate: 

 

International Class 6

Metal key chains.

 

International Class 16

Bumper stickers, posters, paper banners.

 

International Class 18

Leather key chains.

 

International Class 20

Plastic banners, non-metal and non-leather key chains.

 

International Class 21

Coffee mugs and cups.

 

International Class 24

Towels and cloth banners.

 

International Class 25

T-shirts, polo shirts and caps.

 

Please note that, while the identification of goods may be amended to clarify or limit the goods, adding to the goods or broadening the scope of the goods is not permitted.  37 C.F.R. §2.71(a); TMEP §1402.06.  Therefore, applicant may not amend the identification to include goods that are not within the scope of the goods set forth in the present identification.

Requirements for Combined Applications

Applicant must clarify the number of classes for which registration is sought.  The submitted filing fees are insufficient to cover all the classes in the application.  Specifically, the application identifies goods that are classified in at least seven international classes, however applicant paid the fee for only one class.

 

Applicant must either: (1) restrict the application to the number of classes covered by the fee already paid, or (2) pay the required fee for each additional class.  37 C.F.R. §2.86(a)(2); TMEP §§810.0l, 1401.04, 1401.04(b) and 1403.01.

 

If applicant prosecutes this application as a combined, or multiple‑class application, then applicant must comply with each of the requirements below for those goods based on actual use in commerce under Trademark Act Section 1(a):

 

(1)   Applicant must list the goods by international class with the classes listed in ascending numerical order;

 

(2)   Applicant must submit a filing fee for each international class of goods not covered by the fee already paid (current fee information should be confirmed at http://www.uspto.gov); and

 

(3)   For each additional class of goods, applicant must submit:

 

(a)    dates of first use of the mark anywhere and dates of first use of the mark in commerce, or a statement that the dates of use in the initial application apply to that class; the dates of use, both anywhere and in commerce, must be at least as early as the filing date of the application;

 

(b)   one specimen showing use of the mark for each class of goods; the specimen must have been in use in commerce at least as early as the filing date of the application;

 

(c)    a statement that “the specimen was in use in commerce on or in connection with the goods listed in the application at least as early as the filing date of the application;” and

 

(d)   verification of the statements in 3(a) and 3(c) in an affidavit or a signed declaration under 37 C.F.R. §2.20.  (NOTE:  Verification is not required where (1) the dates of use for the added class are stated to be the same as the dates of use specified in the initial application, or (2) the original specimens are acceptable for the added class.)

 

37 C.F.R. §§2.6, 2.34(a), 2.59, 2.71(c), and 2.86(a); TMEP §§810, 904.09, 1403.01 and 1403.02(c).

 

Please note that the specimen of record is not acceptable for any of the classes of goods.

 

Standard Character Mark Claim Omitted

Applicant must submit the following standard character claim:  “The mark consists of standard characters without claim to any particular font, style, size, or color.”  37 C.F.R. §2.52(a); TMEP §807.03(a).

 

Mark Differs on Drawing and Specimen

The applicant has submitted one proposed specimen of use, a t-shirt, for the Class 25 clothing goods.  The mark as depicted on the drawing does not agree with the mark as it appears on the specimen, and clarification is required.  37 C.F.R. §2.51; TMEP §807.12.  Specifically, the drawing displays the mark as the wording ANYONE ANYWHERE ANYTIME, without any quotation marks or periods, and the specimen depicts the mark as “ANYONE. ANYWHERE. ANYTIME.” with periods after each word and parentheses at the beginning and end.

 

Applicant must either:

 

(1)   submit a new drawing of the mark that agrees with the mark as it appears on the specimen and that is not a material alteration of the original mark; 37 C.F.R. §2.72(a); TMEP §§807.14 et seq;

 

(2)   submit a substitute specimen that shows use of the mark as it presently appears on the drawing and is accompanied by a statement that “the substitute specimen was in use in commerce at least as early as the filing date of the application,” verified with an affidavit or a signed declaration under 37 C.F.R. §2.20; 37 C.F.R. §§2.59(a) and 2.72(a); TMEP §904.09; or

 

(3)   amend the application basis to intent-to-use under Section 1(b), and satisfy all the requirements for this new basis.  TMEP §806.03(c).

 

Specimen Unacceptable as Evidence of Actual Use – Failure to Function

With regard to the Class 6, 16, 18, 20, 21 and 24 goods, the specimen is unacceptable because it does not show use of the mark on the identified goods.  In addition to the mark differing on the drawing and proposed specimen, the specimen only shows the mark on a t-shirt, not on any of the other identified goods from different classes, specifically, key chains, bumper stickers, posters, banners, towels, coffee mugs and cups.

 

Applicant must submit (1) a substitute specimen showing the mark as it is used in commerce on the goods or on packaging for each class of goods, and (2) a statement that “the substitute specimens were in use in commerce at least as early as the filing date of the application,” verified with a notarized affidavit or a signed declaration under 37 C.F.R. §2.20.  37 C.F.R. §§2.56 and 2.59(a); TMEP §§904.01 et seq. and 904.09.

 

Examples of acceptable specimens for goods are tags, labels, instruction manuals, containers, photographs that show the mark on the goods or packaging, or displays associated with the goods at their point of sale.  TMEP §§904.04 et seq.

 

Applicant should add the following declaration paragraph to the end of its response, and include a dated signature by a person authorized under 37 C.F.R. §2.33(a).  37 C.F.R. §2.20.

 

The substitute specimens were in use in commerce at least as early as the filing date of the application.  The undersigned, being hereby warned that willful false statements and the like so made are punishable by fine or imprisonment, or both, under 18 U.S.C. §1001, and that such willful false statements and the like may jeopardize the validity of the application or document or any resulting registration, declares that the facts set forth in this application are true; all statements made of his/her own knowledge are true; and all statements made on information and belief are believed to be true.

Pending an adequate response to the above, registration is refused because the specimen of record does not show use of the proposed mark as a trademark.  Trademark Act Sections 1, 2 and 45, 15 U.S.C. §§1051, 1052 and 1127; TMEP §§904.11 and 1202 et seq.

 

Although the trademark examining attorney has refused registration, applicant may respond to the refusal to register by submitting evidence and arguments in support of registration.
