The assigned examining attorney has reviewed the referenced application and determined the following.

 

No Conflicting Marks Noted

The examining attorney has searched the Office records and has found no similar registered or pending mark which would bar registration under Trademark Act Section 2(d), 15 U.S.C. §1052(d).  TMEP §704.02.

 

The applicant must respond to the following issues before this application may proceed to publication.

 

Identification and Classification of Goods

The identification of the applicant’s goods “plastic holder for Christmas tree lights” is unacceptable as indefinite because it does not identify the goods specifically enough.  If it is a commercially used storage container for the lights, the goods are in Class 20.  If it is the nature of a clip, then plastic clips for holding Christmas tree lights is in Class 20.  If the goods are for storing the lights for household use, the goods are in Class 21.  The goods “plastic container for watering Christmas trees” is in Class 21.  The applicant paid for only one class.  For clarity, the examining attorney has listed the applicant’s goods below, indicating, if necessary, a suggestion for a correct identification and classification.  TMEP §1402.01 and  37 C.F.R. §§2.32(a)(7) and 2.85; TMEP §§1401.02(a) and 1401.03(b).

 

The applicant may adopt the following identifications and classifications, if accurate: 

 

            Plastic storage containers for holding Christmas tree lights for commercial use in Class 20.

 

            Plastic storage containers for holding Christmas tree lights for commercial use for household use; plastic container for watering Christmas trees in Class 21.

 

Applicant must submit samples of advertisements or promotional materials and a photograph of the “plastic holder” goods because the nature of the goods on which applicant intends to use its mark is not clear from the present record.  If such materials are not available, then applicant must submit samples of advertisements or promotional materials and a photograph of similar goods.  In addition, applicant must describe in some detail the nature, purpose and channels of trade of the goods listed in the application.  37 C.F.R. §2.61(b); TMEP §§814 and 1402.01(e).

Please note that, while the identification of goods may be amended to clarify or limit the goods, adding to the goods or broadening the scope of the goods is not permitted.  37 C.F.R. §2.71(a); TMEP §1402.06.  Therefore, applicant may not amend the identification to include goods that are not within the scope of the goods set forth in the present identification.

If applicant prosecutes this application as a combined, or multiple-class application, then applicant must comply with each of the following for those goods based on an intent to use the mark in commerce under Trademark Act Section 1(b): 

 

(1)   Applicant must list the goods and/or services by international class with the classes listed in ascending numerical order.  TMEP § 1403.01; and

 

(2)   Applicant must submit a filing fee for each international class of goods and/or services not covered by the fee already paid (current fee information should be confirmed at http://www.uspto.gov).  37 C.F.R. §2.86(a)(2); TMEP §§810 and 1403.01.
