The assigned trademark examining attorney has reviewed the referenced application and has determined the following:
Applicant must specify the colors that are claimed as a feature of the mark using the following format: “The color(s) blue and orange are claimed as a feature of the mark.” 37 C.F.R. §2.52(b)(1); TMEP §807.07(a)(i). Common color names should be used to describe the colors in the mark, e.g., red, yellow, blue. TMEP §807.07(a)(ii).
Applicant must also provide a description of where the colors appear in the mark. 37 C.F.R. §2.52(b)(1); TMEP §807.07(a)(i). The following description is suggested: “The color dark blue appears in the wording ‘uality Assured’, the color orange appears in the ‘Q’ in Quality, and the color blue appears in the background.” Common color names should be used to describe the colors in the mark, e.g., red, yellow, blue. TMEP §807.07(a)(ii).
SPECIMEN
This application does not include a specimen for any of the identified class(es) of goods. A specimen showing use of the mark in commerce for each class of goods is required for an application based on use of the mark in commerce under Trademark Act Section 1(a), 15 U.S.C. §1051(a). TMEP §904.
Applicant must submit (1) a specimen (i.e., an example of how applicant actually uses its mark in commerce for the goods listed in the application) for each class of goods showing the mark as it is used in commerce, and, (2) a statement that “the specimen was in use in commerce at least as early as the filing date of the application,” verified with an affidavit or signed declaration under 37 C.F.R. §2.20. 37 C.F.R. §2.56(a); TMEP §§904.01 et seq. and 904.09.
Examples of acceptable specimens for goods are tags, labels, instruction manuals, containers, photographs that show the mark on the goods or packaging, or displays associated with the goods at their point of sale. TMEP §§904.04 et seq.
If applicant cannot comply with the requirement for specimenfor the use basis asserted, then applicant may substitute a different basis for filing if applicant can meet the requirements for the new basis. See TMEP §§806.03 et seq. In this case, applicant may wish to amend the application to assert an intent to use basis.
Where an application is based on a bona fide intention to use the mark in commerce, applicant must submit the following statement:
Applicant has had a bona fide intention to use the mark in commerce on or in connection with the goods or services listed in the application as of the filing date of the application.
This statement must be verified with a notarized affidavit or a signed declaration under 37 C.F.R. §§2.20 and 2.33. Trademark Act Section 1(b), 15 U.S.C. §1051(b); 37 C.F.R. §2.34(a)(2); TMEP §806.01(b).
DISCLAIMER
The applicant must insert a disclaimer of QUALITY ASSURED in the application, for the wording is merely descriptive of a feature of the goods that are in quality assured. See the attached evidence. Trademark Act Section 6, 15 U.S.C. Section 1056; TMEP sections 1203.
A properly worded disclaimer should read as follows:
No claim is made to the exclusive right to use QUALITY ASSURED apart from the mark as shown.
GENERAL INFORMATION
