AMENDMENT(S) AUTHORIZED: As authorized by Robert Mulcahy on February 14, 2006, the application is amended as noted below. If applicant disagrees with or objects to any of the amendments below, please notify the undersigned trademark examining attorney immediately. Otherwise, no response is necessary. TMEP §707.
I. AMENDMENT TO THE IDENTIFICATION OF GOODS AND SERVICES
The identification of goods and services is amended to read as follows:
“Semiconductor manufacturing machines for the processing, production and manufacture of semiconductor materials, substrates, reticles, thin films, silicon discs and wafers, and structural component parts and fittings therefor, excluding said machines and component parts and fittings therefor for use in the field of flow instrumentation” in International Class 7.
“Manufacturer representatives and wholesale distributorships in the field of semiconductor manufacturing equipment and materials used in the manufacture of semiconductors excluding the field of flow instrumentation” in International Class 35.
“Maintenance and repair of semiconductor manufacturing equipment and machines excluding said equipment and machines for use in the flow instrumentation field” in International Class 37.
Please note that the Section 2(d) refusal and possibility of refusal under Section 2(d) of the Act is withdrawn. Moreover, the requirement for a substitute specimen is also withdrawn. Furthermore, the examiner accepts and acknowledges the dates of use submitted, and the claim of ownership of prior registrations in that the prior registrations claimed have not yet been cancelled.
