This letter responds to applicant’s communication filed on April 3, 2006.  Applicant’s amended recitation was received and made of record.  The following matter remain.

 

Significance of Mark

 

Applicant must specify whether “ROSEMONT” has any significance in the trade or industry, any geographical significance, or any meaning in a foreign language.  37 C.F.R. §2.61(b).

 

This requirement in maintained and continued.

 

 

 

NEW MATTER

 

Drawing

 

Applicant must submit a new drawing showing the entire mark clearly and conforming to 37 C.F.R. §§2.52, 2.53(c) and 2.54(e).  The current drawing is not acceptable because it too blurry and it will not reproduce satisfactorily.  The substitute drawing also contains a line that is not a part of the mark.

 

To submit a special form drawing electronically, applicant must attach a digitized image of the mark to the submission.  The digitized image must be in .jpg format, formatted at no less than 300 dots per inch and no more than 350 dots per inch.  The Office recommends that the digitized image of the mark have a length and width of no smaller than 250 pixels and no larger than 944 pixels.  37 C.F.R. §2.53(c); TMEP §807.05(c).  All lines in the image must be clean, sharp and solid, and not fine or crowded, and produce a high quality image when copied. 

 

Color Claim and Description

 

In its response, the applicant indicates that the colors, Red, Green, White, Black are claimed as a feature of the mark.  The applicant states that “the mark consists of Rose - Red with White spaces Leaves - Green.”

 

The color description does not list all the colors appearing in the drawing of the mark.  Applicant must submit a complete color description of the mark that reference all the colors appearing in the drawing of the mark.  37 C.F.R. §2.52(b)(1); TMEP §807.07(a)(ii). 

 

The following color claim and color description are suggested:  “the mark consists of a rose in red with white spaces; leaves in green; and the wording ‘ROSEMONT’ in black.”
