The examining attorney has searched the Office records and has found no similar registered or pending mark which would bar registration under Trademark Act Section 2(d), 15 U.S.C. Section 1052(d).  TMEP section 1105.01.

 

Clarification of Entity Type

In the preamble, applicant’s name includes the letters “LLC,” yet the preamble later lists applicant as a California company.  Normally, the letters “LLC” indicate that applicant is a limited liability company.”  Inquiry is made as to whether the designation of applicant as being a company is correct.  If not, the entity designation should be corrected (e.g., a limited liability company).

 

Standard Character Claim

Applicant must submit the following standard character claim:  “The mark consists of standard characters without claim to any particular font style, size, or color.”  37 C.F.R. §2.52(a); TMEP §807.03(a).
