Search Results

The Office records have been searched and no similar registered or pending mark has been found that would bar registration under Trademark Act Section 2(d), 15 U.S.C. §1052(d).  TMEP §704.02.  However, applicant must respond to the following requirement(s).

 

Recitation of Services

The wording used to describe the services in International Class 41 needs clarification because it contains services that are classified in other international classes, namely television transmission services in International Class 41.  Applicant must amend the recitation to classify the services correctly.  TMEP §1402.01.  Applicant may adopt the following identification of services, if accurate:

 

Communications services, namely, the transmission and delivery of promotional, informational, entertainment, and interactive television programming services via television, cable and satellite and on-line electronic communications networks; television transmission services in International Class 38.

 

Entertainment services, namely, the production and distribution of promotional, informational, and interactive television programming services via television, cable, satellite and on-line electronic communications networks; entertainment services in the nature of programming, production, and distribution of motion pictures and television programs for television broadcasting and viewing in International Class 41.

 

Additions to Recitation

Please note that, while the identification of services may be amended to clarify or limit the services, adding to the services or broadening the scope of the services is not permitted.  37 C.F.R. §2.71(a); TMEP §1402.06.  Therefore, applicant may not amend the identification to include services that are not within the scope of the services set forth in the present identification.

Applicant must insert a disclaimer of the term GUIDE in the application because it is descriptive of applicant’s services.  Trademark Act Section 6, 15 U.S.C. §1056; TMEP §§1213 and 1213.08(a)(i).  Specifically, applicant is producing and transmitting entertainment and television programming via cable satellite and online electronic communications networks.  See attached dictionary definition of the term GUIDE.

NOTICE:  FEE CHANGE   

 

Effective January 31, 2005 and pursuant to the Consolidated Appropriations Act, 2005, Pub. L. 108-447, the following are the fees that will be charged for filing a trademark application:

 

(1) $325 per international class if filed electronically using the Trademark Electronic Application System (TEAS); or 

 

(2)   $375 per international class if filed on paper

 

These fees will be charged not only when a new application is filed, but also when payments are made to add classes to an existing application. If such payments are submitted with a TEAS response, the fee will be  $325 per class, and if such payments are made with a paper response, the fee will be $375 per class.

 

The new fee requirements will apply to any fees filed on or after January 31, 2005.
