Search Results
The Office records have been searched and no similar registered or pending mark has been found that would bar registration under Trademark Act Section 2(d), 15 U.S.C. §1052(d). TMEP §704.02. Before the application can proceed to publication, however, certain informalities must be addressed.
This application and registration No. 75297233 appear to be duplicates, and one of them must be abandoned. The U.S. Patent and Trademark Office will not issue duplicate registrations. TMEP §703. (See attached.)
Requirements for an Application Based on Section 44(e)-Note bolded language
Where an application is based on a foreign registration, applicant must satisfy the following requirements:
(1) Applicant must submit a true copy, a photocopy, a certification, or a certified copy of a registration of the mark in applicant's country of origin. Applicant's country of origin must either be a party to a convention or treaty relating to trademarks to which the United States is also a party or extend reciprocal registration rights to nationals of the United States by law. See TMEP §§1002 et seq. and 1004.01 et seq.
(2) An English translation of the foreign registration must also be submitted if the foreign certificate of registration is not written in English. The translator should sign the translation. TMEP §1004.01(b).
(3) The following statement must also be included: "Applicant has had a bona fide intention to use the mark in commerce on or in connection with the identified goods or services as of the application filing date." This statement must be verified in a notarized affidavit or a signed declaration under 37 C.F.R. § §2.20 and 2.33.

Response to Office Action
Applicant should include the following information on all correspondence with the Office: (1) the name and law office number of the trademark examining attorney; (2) the serial number of this application; (3) the mailing date of this Office action; and, (4) applicant's telephone number. 37 C.F.R. §2.194(b)(1); TMEP §302.03(a).

Effective January 31, 2005 and pursuant to the Consolidated Appropriations Act, 2005, Pub. L. 108-447, the following are the fees that will be charged for filing a trademark application:
(1) $325 per international class if filed electronically using the Trademark Electronic Application System (TEAS); or
(2) $375 per international class if filed on paper
These fees will be charged not only when a new application is filed, but also when payments are made to add classes to an existing application. If such payments are submitted with a TEAS response, the fee will be $325 per class, and if such payments are made with a paper response, the fee will be $375 per class.
The new fee requirements will apply to any fees filed on or after January 31, 2005.
