The 2(d) refusal of the application for Class 24 goods is no longer applicable, since the cited registration merely addresses pillows. Applicants goods no longer are in the realm of bedding and therefore there does not exist a likelihood of confusion in the minds of the consumer. This amendment is consistent with the discussion applicant's attorney had with the Examining attorney back in early July. Timely approval and publication of the application is respectfully requested. |
