The application was approved from publication on September 1, 2005. Unfortunately, new issues have been brought to light that must be addressed before the application may be published in the Official Gazette. The examining attorney has determined the following:
The identification of goods is unacceptable as indefinite because “playing cards” fall within the scope of Class 28, and “ornamental decorative table accessories” is overly broad, requiring the nature and composition of such goods for proper classification. The applicant may adopt the following identification, if accurate:
Books, souvenir programs, journals, and manuals pertaining to the game of golf and to golf tournaments; pairing sheets, posters, and lithographic prints; calendars, and stationery; desk sets and paperweights; pens and pencils, in International Class 16.
Beverage ware; plastic cups and mugs; pewter mugs; ornamental decorative table accessories, namely, decorative [specify, e.g., prisms, glass, plates, etc.], in International Class 21.
Sporting goods used in connection with the game of golf, namely gloves, golf bags, golf balls, golf flags, golf clubs, and golf bag accessories, namely golf head covers, divot repair tools, and golf ball markers; playing cards, in International Class 28.
