The request for extension of time to file a statement of use (extension request) filed on February 25, 2009, does not meet the minimum filing requirements and is not accepted for the reason(s) set forth below.

 

A grant of the requested extension would cause the total time period in which the applicant may file the Statement of Use to exceed 36 months following issuance of the Notice of Allowance, in contravention of the Trademark Act.  15 U.S.C. §1051(d)(2) and 37 C.F.R. §2.89(c).

 

Since the period of time within which the applicant could file an acceptable extension request or Statement of Use has expired, the application will be abandoned in due course. The fee for filing the extension request will be refunded.

 

Please note that filing a petition to revive the application cannot be recommended in this case.  A petition will not be granted if it would result in extending the time period for filing a statement of use beyond 36 months from the issue date of the notice of allowance, the maximum extension time period permitted.  15 U.S.C. §1051(d)(2); 37 C.F.R. §§2.66(d) and 2.89(e)(1).  Applicant may file a new application.
