The assigned examining attorney has reviewed the referenced application and determined the following.
I. OFFICE RECORDS
The examining attorney has searched the Office records and has found no similar registered or pending mark which would bar registration under Trademark Act Section 2(d), 15 U.S.C. Section 1052(d). TMEP section 1105.01.
II. IDENTIFICATION OF GOODS
The wording “body butter” in the identification of goods is unacceptable as indefinite. TMEP section 1402. In the identification of goods, the applicant must use the common commercial or generic names for the goods, be as complete and specific as possible, and avoid the use of indefinite words and phrases. If the applicant chooses to use indefinite terms, then such terms must be followed by the word "namely" and a list of the specific goods identified by their common commercial or generic names. TMEP §§1402.01 and 1402.03(a). The applicant may, for example, adopt the following identification, if accurate:
In International Class 3; body care products, namely, body lotion, body wash, body scrub and cocoa butter for cosmetic purposes.
Please note that, while an application may be amended to clarify or limit the identification, additions to the identification are not permitted. 37 C.F.R. Section 2.71; TMEP section 1402. Therefore, the applicant may not amend to include any goods that are not within the scope of the goods identified in the present identification.
For the applicant’s convenience, the Trademark Acceptable Identification of Goods and Services Manual can be found online at: http://www.uspto.gov/web/offices/tac/doc/gsmanual/. It offers a searchable list of acceptable identifications and classifications, and although it is not an exhaustive list, it is nonetheless a very useful guide in formulating acceptable identifications.
III. ENTITY TYPE OMITTED
The applicant must specify what type of entity is applying, e.g., an individual, partnership, corporation or joint venture. 37 C.F.R. §2.32(a)(3); TMEP §§803.03 et seq.
IV. CONCLUSION
All of the issues raised can be resolved by telephone. Accordingly, the applicant may telephone the examining attorney, instead of submitting a written response, to expedite the application.
