This Office Action responds to the applicant’s correspondence of June 12, 2006. Having carefully considered the applicant’s statement of use, the examining attorney hereby continues his FINAL refusal with respect to the applicant’s specimen of use, and raises the following requirement.
In the Notice of Allowance, the identification of goods reads as follows:
In International Class 10; medical apparatus, namely, equipment for computer assisted detection of health related abnormalities in medical images, and software sold as a unit.
In its June 12, 2006 response, however, the applicant has proposed amending its identification to read “leasing of medical equipment” in International Class 44.
The applicant must amend the identification of goods and/or services in the Statement of Use to conform to the identification in the Notice of Allowance. The identification in the Statement of Use is not acceptable because it designates goods and/or services that are broader in scope than the identification that was set forth in the application at the time of filing or as expressly amended. See 37 C.F.R. §2.71(a); TMEP §§1402.06, 1402.06(a) and 1402.07. While an application may be amended to clarify or limit the identification, additions to the identification are not permitted. 37 C.F.R. §2.71(a); TMEP §§1402.06 and 1402.07.
