The assigned trademark examining attorney has reviewed the referenced application filed on May 14, 2004, and has determined the following.
The Office records have been searched and no similar registered or pending mark has been found that would bar registration under Trademark Act Section 2(d), 15 U.S.C. §1052(d). TMEP §704.02.
However, the applicant should note the following informality:
The identification of goods is unacceptable as indefinite because some of the wording is overly broad and could refer to goods for which the applicant does not seek protection. The applicant may adopt the following identification, if accurate:
Pill boxes, vases, flasks for perfume, small domestic utensils, namely, [specify the types of utensils contemplated, e.g., pot and pan scrapers, rolling pins, spatulas, turners, whisks, etc.], general dinnerware, hairbrushes and combs and leather coasters, in International Class 21.

Please note that, while an application may be amended to clarify or limit the identification, additions to the identification are not permitted. 37 C.F.R. Section 2.71(b); TMEP section 1402.01. Therefore, the applicant may not amend to include any goods that are not within the scope of goods set forth in the present identification.
