The applicant’s amended identification of goods is accepted.

 

The applicant’s standard character claim is accepted.

 

The refusal to register, however, is continued because the applicant has attempted to submit a partial amendment to allege use and to divide the application.

 

The applicant’s divisional request was rejected for various reasons.  Accordingly, all three classes remain part of this application.  The applicant may not file a partial amendment to allege use.  TMEP section 1104.03(a).  As a result, the amendments to allege use dealing with classes 27 and 40 cannot be accepted.
