NOTICE OF INCOMPLETE DIVISIONAL REQUEST

 

TO AVOID THE DENIAL OF YOUR REQUEST TO DIVIDE THE APPLICATION, WE MUST RECEIVE A PROPER RESPONSE TO THIS NOTICE  WITHIN THIRTY (30) OF OUR MAILING OR E-MAILING DATE.

A Request to Divide an application must be submitted as a separate document and should not be included in any other amendment or response in the application.  The title “Request to Divide application” should appear at the top the document. 37 C.F.R. §2.87(d)

 

The fee for processing a Request to Divide is $100.00 for each new file created.  If you want to divide some, but not all, of the goods or services in a class, a new application fee must be submitted for each new application created, in addition to the $100 divisional fee.  The application filing fee currently is $335.  However, please note that beginning January 31, 2005, this fee will increase to $375 per class for applications filed on paper.

 

When a divisional request is filed with a Statement of Use ($100 per class fee) and/or an extension request ($150 per class), the fees for those documents must be filed with the Request to Divide.

 

Please be advised that you have thirty days from the mailing date of this letter to submit the required fee(s) and a separate Request to Divide the application.  If the fee(s) and request are not received before the end of the thirty-day period, the divisional request will be dismissed and the application will be returned to its previous status.
