The examining attorney has searched the Office records and has found no similar registered or pending mark which would bar registration under Trademark Act Section 2(d), 15 U.S.C. §1052(d).  TMEP §704.02.

 

Applicant May Not Amend from 1(b) to 1(a) Basis Without Filing an Amendment to Allege Use

Applicant may not amend an application filed under Section 1(b) (intent to use in commerce) to assert a Section 1(a) (use in commerce) basis unless applicant also files an allegation of use under Trademark Act Sections 1(c) or 1(d), 15 U.S.C. §§1051(c) or (d). 37 C.F.R. §2.35(b)(8).

 

 

The allegation of use can be filed electronically using the Trademark Electronic Application System (TEAS), available at http://www.uspto.govSee TMEP §301 for additional information about electronic filing.  Alternatively, the owner can call the Trademark Assistance Center at (703) 308-9000 or (800) 786-9199 to obtain a form (“Trademark/Service Mark Allegation of Use)” that can be used to file either an amendment to allege use or a statement of use via mail, fax or hand delivery.  TMEP Section 1103.

 

Fee Increase

Fee increase effective January 1, 2003

Effective January 1, 2003, the fee for filing an application for trademark registration will be increased to $335.00 per International Class.  The USPTO will not accord a filing date to applications that are filed on or after that date that are not accompanied by a minimum of $335.00. 

 

Additionally, the fee for amending an existing application to add an additional class or classes of goods/services will be $335.00 per class for classes added on or after January 1, 2003.
