The assigned examining attorney has reviewed the referenced application and determined the following.
The Office records have been searched and no similar registered or pending mark has been found that would bar registration under Trademark Act Section 2(d), 15 U.S.C. §1052(d). TMEP §704.02.
Applicant must submit the following standard character claim: “The mark is presented in standard characters without claim to any particular font style, size, or color.” 37 C.F.R. §2.52(a).
Identification of Goods and Services
The wording “computer software for use in business process modeling” in the identification of goods needs clarification because the applicant must indicate the specific function of the computer software. Applicant may change this wording to “computer software for use in business process modeling for the purpose of <specify function>,” if accurate. TMEP §1402.01.
The wording “enterprise modeling and analysis for business process improvement, workflow simulations, and enterprise modeling” in the identification of services needs clarification because the applicant must indicate the type of services. Applicant may change this wording to “business consultation services in the field of enterprise modeling and analysis for business process improvement, workflow simulations and enterprise modeling,” if accurate. TMEP §1402.01.
Please note that, while the identification of goods and/or services may be amended to clarify or limit the goods and/or services, adding to the goods and/or services or broadening the scope of the goods and/or services is not permitted. 37 C.F.R. §2.71(a); TMEP §1402.06. Therefore, applicant may not amend the identification to include goods and/or services that are not within the scope of the goods and/or services set forth in the present identification.
