The assigned examining attorney has reviewed the referenced application and determined the following.
NO CONFLICTING MARKS:
The examining attorney has searched the Office records and has found no similar registered or pending mark which would bar registration under Trademark Act Section 2(d), 15 U.S.C. §1052(d). TMEP §704.02.
DISCLAIMER:
The applicant must disclaim the descriptive wording “DECOY BAGS” apart from the mark as shown. Trademark Act Section 6, 15 U.S.C. §1056; TMEP §§1213 and 1213.03(a). The wording is merely descriptive of the applicant’s goods. The term DECOY refers to 1.a. A living or artificial bird or other animal used to entice game into a trap or within shooting range. b. An enclosed place, such as a pond, into which wildfowl are lured for capture.[1] The term BAG refers to 1.a. A container of flexible material, such as paper, plastic, or leather, that is used for carrying or storing items.[2]
The computerized printing format for the Trademark Official Gazette requires a standard form for a disclaimer. TMEP §1213.08(a)(i). A properly worded disclaimer should read as follows:
No claim is made to the exclusive right to use “DECOY BAGS” apart from the mark as shown.
See In re Owatonna Tool Co., 231 USPQ 493 (Comm’r Pats. 1983).
SPECIMEN NOT ACCEPTABLE:
Applicant must submit (1) a substitute specimen showing the mark as it is used in commerce on the goods or on packaging for the goods, and (2) a statement that “the substitute specimen was in use in commerce at least as early as the filing date of the application,” verified with a notarized affidavit or a signed declaration under 37 C.F.R. §2.20. 37 C.F.R. §§2.56 and 2.59(a); TMEP §904.09.
The current specimens of record comprise advertising material and are unacceptable as evidence of actual trademark use because it fails to show the mark directly on the goods and/or packaging. Examples of acceptable specimens for goods are tags, labels, instruction manuals, containers, photographs that show the mark on the goods or packaging, or displays associated with the goods at their point of sale. TMEP §§904.04 et seq.
SUBSTITUTING A BASIS:
If the applicant cannot comply with the specimen requirement for the Section 1(a) basis asserted, the applicant may substitute a different basis for filing if the applicant can meet the requirements for the new basis. See TMEP §§806.03 et seq.
In this case, the applicant may wish to amend the application to assert a Section 1(b) basis.
STANDARD CHARACTER DRAWING CLAIM:
NOTE: The Trademark Rules pertaining to drawings were amended on November 2, 2003. For applications filed after November 2, 2003, applicants must follow the new standard character drawing rules. Exam Guide 01-03, section I.A.9.
Applicant must submit the following standard character claim: “The mark is presented in standard characters without claim to any particular font style, size, or color.” 37 C.F.R. §2.52(a).
