The Office records have been searched and no similar registered or pending mark has been found that would bar registration under Trademark Act Section 2(d), 15 U.S.C. §1052(d).  TMEP §704.02.

Disclaimer

Applicant must disclaim the descriptive wording “CROSSVENT” apart from the mark as shown because it is merely descriptive of a feature of the applicant’s insulation.  It immediately tells something about the insulation – insulation that provides a “vent” that allows “interchange” of air.[1]  The applicant is referred to the attached dictionary definitions of “cross,” “ventilation” and “vent.”  The applicant’s insulation allows for a “ventilation space between the insulation and OSB to reduce heat buildup” (per the applicant’s specimens).  Furthermore, the applicant is referred to the attached random sampling of excerpts found on the Internet in which “cross ventilation” is used descriptively with respect to insulation.  No imagination, thought or perception is required to determine the nature of the goods from the terminology.  Trademark Act Section 6, 15 U.S.C. §1056; TMEP §§1213 and 1213.03(a).

 

The computerized printing format for the Office’s Trademark Official Gazette requires a standardized format for a disclaimer.  TMEP §1213.08(a)(i).  The following is the standard format used by the Office:
