To the Commissioner for Trademarks:

The registrant requests the following amendment(s) to registration no. 2999940 AERO MOCK-UPS/BETTER THAN THE REAL THING (Stylized and/or with Design, see http://uspto.report/TM/76578380/mark.png) has been amended as follows:

EXPLANATION OF FILING

There is a typo in the disclaimer statement that needs to be corrected.  On September 27, 2004, the Examining Attorney issued an Office Action in which he required the Applicant to disclaim the exclusive right to use “AERO MOCK-UPS” apart from the mark as shown.  On February 16, 2005, Applicant filed a Response to Office Action in which it agreed to the disclaimer of “AERO MOCK-UPS.”

 

However, when the USPTO entered the disclaimer into its system, the Office made a typographical error, so that the disclaimer reads “No claim is made to the exclusive right to use "AFRO MOCK-UPS" apart from the mark as shown.

 

Registrant respectfully requests that the Office correct this error to replace the term AFRO with AERO in the disclaimer, so that the disclaimer is correctly stated.  If the Office has any questions or would like to discuss, please do not hesitate to telephone the undersigned attorney.
