Although applicant requested that certain goods and/or services remain in the original application (parent application), Office policy is to divide out into a child application those goods and/or services most ready to move forward toward registration, i.e., those goods and services for which an amendment to allege use or statement of use has been filed.
The request to divide application serial no. 76577150, filed on August 2, 2006, has been processed as follows:
(1) Parent (original) application serial no. 76/577,150 contains the following services: Class 35 for Product merchandising and licensing of cards, glassware, tableware, tee-shirts, tote bags, CD's and magazines. To avoid abandonment, applicant must continue to file requests for extension of time to file a statement of use (extension requests) or a statement of use before expiration of the notice of allowance or current extension period. 37 C.F.R. §§2.88(a) and 2.89(g).
(2) Child application serial no. 76/978,307 contains the following services: Class 35 for Product merchandising and licensing of planners. A Statement of Use filed on August 1, 2006, has been placed in the child application and routed to the examining attorney for examination.
