The Combined Section 8 Affidavit & Section 9 Renewal Application was received on The nonuse portion of the Section 8 Affidavit cannot be accepted because ( see below.)

June 28, 2011.  The Section 9 portion of the combined filing can be granted.  However, the Section 8 portion is not accepted for the reason(s) set forth below.

 

In order to further evaluate the non-use affidavit the registrant must provide informortion as to the nature of the owner’s unique role and knowledge such that the business can’t continue to operate without this particular individual.

 

In addition the statutory deadline isn’t over until July 24, 2012 so you have time to file a new declaration with the appropriate fee and asserting use in commerce.

 

RESPONSE TIME DEADLINE:  A complete response must be received within 6 months from the issuance date of this Office action
