The assigned trademark examining attorney has reviewed the referenced application filed on February 20, 2004, and has determined the following.
The examining attorney has searched the Office records and has found no similar registered or pending mark which would bar registration under Trademark Act Section 2(d), 15 U.S.C. §1052(d). TMEP §704.02.
Applicant must submit the following standard character claim: “The mark is presented in standard characters without claim to any particular font style, size, or color.” 37 C.F.R. §2.52(a).
The wording “systems” and “components” in the identification of goods is unacceptable as indefinite and/or misclassified. The applicant must list the common commercial name of the systems and components. If it is not possible to list the common commercial name of the system, then “system” must be amended to “system comprising” followed by a listing of the common commercial name of the major components comprising the system. Also, the applicant must amend the classification of the goods to Class 7, which is the proper class. The applicant may adopt the following identification, if accurate:
Motorcycle exhaust system comprising exhaust pipe, intake pipe, and filter; automotive and truck intake system comprising intake pipe; automotive and truck cooling system comprising pumps and radiators for cooling engines; and and automotive and truck exhaust system comprising exhaust pipe, in Class 7.
TMEP §1402.01.
Please note that, while an application may be amended to clarify or limit the identification, additions to the identification are not permitted. 37 C.F.R. Section 2.71(a); TMEP section 804.09. Therefore, the applicant may not amend to include any goods or services that are not within the scope of the goods and services recited in the present identification.
Fee Increase
Fee increase effective January 1, 2003
Effective January 1, 2003, the fee for filing an application for trademark registration will be increased to $335.00 per International Class. The USPTO will not accord a filing date to applications that are filed on or after that date that are not accompanied by a minimum of $335.00.
Additionally, the fee for amending an existing application to add an additional class or classes of goods/services will be $335.00 per class for classes added on or after January 1, 2003.
