OFFICE SEARCH:  The examining attorney has searched the Office records and has found no similar registered or pending mark which would bar registration under Trademark Act Section 2(d), 15 U.S.C. Section 1052(d).  TMEP section 704.02. 

 

TO AVOID ABANDONMENT, WE MUST RECEIVE A PROPER RESPONSE TO THIS OFFICE ACTION WITHIN 6 MONTHS OF OUR MAILING OR E-MAILING DATE.  This case will be given priority as an amended case if you respond to the requirements stated below within two months.

The following issues were discussed in communication with John Dupre on August 23, 2004.

 

Standard Character Drawing

The applicant must submit the following standard character claim:  “The mark is presented in standard characters without claim to any particular font style, size, or color.”  37 C.F.R. §2.52(a).

 

Identification of Goods

The identification of goods is unacceptable as indefinite.  TMEP section 1402.  The applicant may, for example, adopt the following recitation, if accurate:

 

In International Class 9;  semiconductor-based light emitting diodes.

 

Please note that, while an application may be amended to clarify or limit the recitation, additions to the identification are not permitted.  37 C.F.R. Section 2.71; TMEP section 1402.  Therefore, the applicant may not amend to include any services that are not within the scope of the goods identified in the present identification.

 

            For the applicant’s convenience, the Trademark Acceptable Identification of Goods and Services Manual can be found online at: http://www.uspto.gov/web/offices/tac/doc/gsmanual/.  It offers a searchable list of acceptable identifications and classifications, and although it is not an exhaustive list, it is nonetheless a very useful guide in formulating acceptable identifications. 

 

Conclusion

All of the issues raised can be resolved by telephone.  Accordingly, the applicant may telephone the examining attorney, instead of submitting a written response, to expedite the application.
