The assigned examining attorney has reviewed the referenced application and determined the following.
A. Search Results
The examining attorney has searched the Office records and has found no similar registered or pending mark which would bar registration under Trademark Act Section 2(d), 15 U.S.C. Section 1052(d). TMEP section 1105.01.
B. Identification and Classification of Goods
The identification of goods is unacceptable as indefinite because the examining attorney is unable to determine the exact nature of the goods. Applicant must clarify the nature of the “acoustic panels,” as well as the material composition and usage for such goods. Applicant must also clarify the nature of the “water shields.” TMEP section 804.
The examining attorney notes that the acoustic panels may or may not be classified in International Class 12. 37 C.F.R. Sections 2.33(a)(1)(vi) and 2.85; TMEP sections 805 and 1401.
When an applicant has submitted an indefinite identification of goods or services, it is Office practice to suggest an acceptable identification. In this case, however, the examining attorney cannot determine the nature of the goods because there is insufficient information in the record. Therefore, applicant may want to review the Office’s online searchable identification and classification manual at www.uspto.gov.
The applicant must rewrite the identification in its entirety, listing each good or service according to its appropriate international classification, with the international classes listed in ascending order. 37 C.F.R. Section 2.74(b). Please note that, while an application may be amended to clarify or limit the identification, additions to the identification are not permitted. 37 C.F.R. Section 2.71(a); TMEP section 804.09. Therefore, the applicant may not amend to include any goods or services that are not within the scope of the goods or services listed in the present identification.
C. Standard Character Drawing Claim Required
Applicant must submit the following standard character claim: “The mark is presented in standard characters without claim to any particular font style, size, or color.” 37 C.F.R. §2.52(a).
