The assigned examining attorney has reviewed the referenced application and determined the following.

SEARCH OF OFFICE RECORDS

The examining attorney has searched the Office records and has found no similar registered or pending mark which would bar registration under Trademark Act Section 2(d), 15 U.S.C. §1052(d).  TMEP §704.02.

 

STANDARD CHARACTER DRAWING CLAIM NEEDED

The Trademark Rules pertaining to drawings were amended on November 2, 2003. For applications filed prior to November 2, 2003, applicants may follow either the new standard character drawing rules or the typed drawing rules in force prior to their amendment on November 2, 2003. Exam Guide 01-03, section I.A.9.

 

For applications filed on or after November 2, 2003, the applicant must comply with the new standard character drawing rules. As such, the applicant must submit the following standard character claim: “The mark is presented in standard characters without claim to any particular font style, size, or color.” 37 C.F.R. §2.52(a).

 

OWNERSHIP OF PRIOR REGISTRATION

If the applicant is the owner of Registration No. 992,426, the applicant must submit a claim of ownership.  37 C.F.R. §2.36; TMEP §812.  See attached registration.  Also, Registration No. 452,726 (claimed in the application) does not appear to be a valid registration.  For this reason, the applicant should delete this registration number from the claim of ownership.  Otherwise, the applicant should provide the Office with information regarding this registration number.

A properly worded claim of ownership should read as follows:

            The applicant is the owner of U.S. Registration No. 992,426.
