Applicant’s request for reconsideration of the 03/23/2005 final refusal and applicant’s notice of appeal are noted. Applicant’s response to the 04/26/2006 Office action is also noted.
Both refusals of record under Trademark Act Section 2(e)(1) were subsequently made FINAL in the 04/26/2006 Office action and those refusals are continued.
