If such materials are not available, then applicant must submit samples of advertisements or promotional materials and a photograph of similar goods. In addition, applicant must describe in some detail the nature, purpose and channels of trade of the goods listed in the application. 37 C.F.R. §2.61(b); TMEP §§814 and 1402.01(d).
Significance of Mark
Applicant must specify whether “MED,” “MEDICAL,” “ART,” “MEDICAL ART” and/or “MEDART” have any significance in the applicant’s trade or industry, any geographical significance, or any meaning in a foreign language. Also, will the catalogs feature artwork? Will they have anything to do with art? Will they feature medical-related subject matter? 37 C.F.R. §2.61(b).
