Applicant must submit samples of advertisements or promotional materials and a photograph of the identified goods so that the subject matter of the catalogs may be ascertained.  If such materials are not available, then applicant must submit samples of advertisements or promotional materials and a photograph of similar goods.  In addition, applicant must describe in some detail the nature, purpose and channels of trade of the goods listed in the application.  37 C.F.R. §2.61(b); TMEP §§814 and 1402.01(d).

 

Significance of Mark

Applicant must specify whether “MED,” “MEDICAL,” “ART,” “MEDICAL ART” and/or “MEDART” have any significance in the applicant’s trade or industry, any geographical significance, or any meaning in a foreign language.  Also, will the catalogs feature artwork?  Will they have anything to do with art?  Will they feature medical-related subject matter?  37 C.F.R. §2.61(b).
