A new drawing page is submitted herewith. Applicant submits that the amendment of the mark deleting the word "The" is not a material alteration of the mark and the specimens submitted herewith with the Statement of Use and Request for Extension of Time which are being filed, concurrently, support the use of the mark as amended. Applicant submits that the modified mark contains the essence of the original mark and is essentially the same mark and should not have to be republished in order to fairly present the mark. Applicant believes that it has complied with all of the provisions of TMEP 807.14(a) and §2.72 of the regulations. It is respectfully requested that the amendment to the drawing be entered and that case be passed to registration at an early date. |
