The assigned trademark examining attorney has reviewed the referenced application filed on November 26, 2003 and has determined the following.

The Office records have been searched and no similar registered or pending mark has been found that would bar registration under Trademark Act Section 2(d), 15 U.S.C. §1052(d).  TMEP §704.02.

 

Identification of Goods/Services

The identification is unacceptable because it is overbroad and could include goods classified in other classes.  Applicant must specify the type of “crystal” it has.  The wording “crystal” is vague.

 

Applicant may adopt the following identification of goods, if accurate: 

 

International Class 8

“Flatware,” in International Class 8.  TMEP §1402.01.

 

International Class 16

“Paper napkins,” in International Class 16.  TMEP §1402.01.

 

International Class 20

Napkin rings not of precious metal, candle holders not of precious metal, porcelain dinnerware, stoneware, namely, _________ [specify items], beverage glassware, flower containers, plastic and metal cooking utensils, cooking pots, casseroles, plastic pitcher sets, hand cream or soap dispenser, melamine dinnerware, ceramic, metal or plastic tumbler, toothbrush holder, soap dish, soap dispenser, coasters, ironing board pads and covers,” in International Class 21.  TMEP §1402.01.

“Fabric table cloths, runners, fabric napkins, fabric place mats, Chair pads, chair slip covers, oven mitts, pot holders, terry Kitchen towels, linen kitchen towels, bath towels, face clothes, bar stool covers, tea cozies, curtains, BBQ mitts, slip covers, bed sheets, pillow cases, comforters, duvet covers, dust ruffles, pillow shams, vinyl place mats, vinyl table cloths, shower curtains,” in International Class 24.  TMEP §1402.01.

“Silk flowers,” in International Class 26.  TMEP §1402.01.

 

International Class 27

“Kitchen rugs, bath mats, and area rugs,” in International Class 27.  TMEP §1402.01.

 

International Class 31

“Dried flowers,” in International Class 31.  TMEP §1402.01.

 

Please note that, while the identification of goods may be amended to clarify or limit the goods, adding to the goods or broadening the scope of the goods is not permitted.  37 C.F.R. §2.71(a); TMEP §1402.06.  Therefore, applicant may not amend the identification to include goods that are not within the scope of the goods set forth in the present identification.

 

Combined Applications

If applicant prosecutes this application as a combined, or multiple-class application, then applicant must comply with each of the following for those goods and/or services based on <an intent to use the mark in commerce under Trademark Act Section 1(b)/a foreign registration under Trademark Act Section 44(e)/an intent to use the mark under Trademark Act Section 1(b) and/or a foreign registration under Trademark Act Section 44(e)>:

 

(1)   Applicant must list the goods and/or services by international class with the classes listed in ascending numerical order.  TMEP § 1403.01; and
