U.S. Registration No. 2215156, which had been cited as a bar to registration of applicant’s mark under Section 2(d) of the Trademark Act, 15 U.S.C. Section 1052(d), has been cancelled. Therefore, the refusal of registration is withdrawn.
The contingent amendment of the goods set forth in applicant’s request for reconsideration, filed August 1, 2005, was entered in error. The examining attorney has restored the identification as it stood prior to that error, namely, to the wording proposed on December 21, 2004. It was accepted in the action mailed January 28, 2005.
The trademark examining attorney is amending the application as follows. No prior approval or authorization from applicant or applicant’s attorney is required. TMEP §707.02.
