The following issues were discussed in communication with Peter S. Sloane on June 25, 2004.
OWNERSHIP OF PRIOR REGISTRATIONS
If applicant is the owner of U.S. Registration Nos. 2814935, 2501025 and 1772761, then applicant must submit a claim of ownership. 37 C.F.R. §2.36; TMEP §812. The following standard format is suggested:

IDENTIFICATION/CLASSIFICATION OF GOODS – INTERNATIONAL CLASS 10
The identification/classification of goods is unacceptable as indefinite because as worded, the exact nature of the goods is unclear. Specifically, the applicant must clarify what it means by “injectors” by their common commercial name.
The applicant may adopt the following identification, if accurate:
“Medical devices, namely, pen injectors and needles for medical use,” in International Class 10.
TMEP §1402.01.
Please note that, while an application may be amended to clarify or limit the identification, additions to the identification are not permitted. 37 C.F.R. §2.71(a); TMEP §1402.06. Therefore, the applicant may not amend to include any goods that are not within the scope of goods set forth in the present identification.
