First, please be advised that on May 10, 2005, the undersigned Lee B. Beitchman, became attorney of record pursuant to a revocation of attorney and appointment of new attorney filed by Applicant with TEAS. Second, the only unresolved issue remaining with this application presented in the Final Action of the PTO dated 2/15/2005 concerns a 2(d) refusal based upon US Registration Nos. 2791674 and 2358368. In response thereto, Applicant hereby tenders a Consent Agreement executed by the principal of KidVid, Inc. the owner of the cited registrations. In that Consent Agreement, a copy of which is attached hereto as evidence, KidVid, Inc. provides that the Applicant of the instant mark is permitted to use its mark, and that neither party believes that confusion will be created as to the use by either. The original is available upon request. Based upon the evidence submitted, Applicant hereby requests approval of its application for registration.
