FIRST USE IN COMMERCE DATE OMITTED

 

Although the statement of use specifies the date of first use anywhere, it omits the required date of first use in commerce.  Trademark Act Section 1(d)(1), 15 U.S.C. §105l(d)(1); 37 C.F.R. §2.88(b)(1); TMEP §§903, 903.02 and 1109.09(a).

 

The applicant must specify the date of first use of the mark in commerce and verify this date with a notarized affidavit or a signed declaration under 37 C.F.R. §2.20.  37 C.F.R. §2.71(c); TMEP §903.

 

ENTITY REQUIRES CLARIFICATION

 

The assignee is set forth as Floodcooling Technologies, L.L.C, but is identified as a limited partnership.  If the applicant is a limited partnership, the applicant must confirm that the name is set forth correctly and provide the following:  (1) the names of the general partners of the limited liability partnership; and (2)  either their national citizenship (for individuals) or the U.S. state or foreign country of their organization or incorporation, as appropriate.  37 C.F.R. §2.32(a)(3)(iii); TMEP §§803.03(h) and 803.04.

 

In the alternative, if the applicant is a limited liability company, the applicant should simply request that the entity type be amended to limited liability company.
