The assigned examining attorney has reviewed the referenced application and determined the following.
The examining attorney has searched the Office records and has found no similar registered or pending mark which would bar registration under Trademark Act Section 2(d), 15 U.S.C. Section 1052(d). TMEP section 1105.01.
The applicant must indicate what type of entity is applying, for example, an individual, partnership, corporation or joint venture. 37 C.F.R. Section 2.32(a)(3); TMEP section 802.03.
Applicant must specify its country of incorporation. 37 C.F.R. §2.32(a)(3)(ii); TMEP §§803.03(c) and 803.04.
The applicant must disclaim the descriptive wording "CORPORATE" apart from the mark as shown. Trademark Act Section 6, 15 U.S.C. Section 1056; TMEP sections 1213 and 1213.02(a). The wording is merely descriptive because it describes the intended user of the services. “Corporate” means “designed for, suitable for, or typical of people who work for large corporations.” See attached definition. Applicant’s transportation services are intended for corporate clients and/or customers. A properly worded disclaimer should read as follows:
