The examining attorney refused registration of Applicant's mark based on registrations 2,1476,91 and 2,813,413 for SIENNA and SIENA STUDIO, respectively. Each of the registrations are for "clothing." Applicant respectively abandons the application for registration of the mark in class 25 for "clothing, for athletic and casual, namely, shirts, shorts, pants, dresses, skirts, sweaters, t-shirts, golf shirts, jackets and sweatshirts, headwear and footwear." Applicant reserves the right to apply for registration of the mark for clothing at a later date.
The examining attorney submitted that Applicant must disclaim "Grille." Applicant respectfully submits that "Grille" is not apart of the mark of this application. Applicant does have a co-pending application, serial no. 75/555,753, for Sienna Grille.
Applicant has responded to all the outstanding rejections and objections and respectfully requests that the examining attorney publish the application for opposition.
The examining attorney is invited to call Applicant's representative to address any issues and to expedite registration of the mark. |
