The assigned examining attorney has reviewed the referenced application and determined the following.

 

NO CONFLICTING MARK NOTED

 

The examining attorney has searched the Office records and has found no similar registered or pending mark which would bar registration under Trademark Act Section 2(d), 15 U.S.C. §1052(d).  TMEP §704.02.

 

MARK IS PRIMARILY MERELY A SURNAME

 

The examining attorney refuses registration on the Principal Register because the mark is primarily merely a surname.  Trademark Act Section 2(e)(4), 15 U.S.C. §1052(e)(4); TMEP §1211.  The examining attorney must consider the primary significance of the mark to the purchasing public to determine whether a term is primarily merely a surname.  In re Kahan & Weisz Jewelry Mfg. Corp., 508 F.2d 831, 184 USPQ 421 (C.C.P.A. 1975).  Please see the attached evidence from LexisNexis®, establishing the surname significance of the mark.  TMEP §§1211 et seq. 

 

Although the examining attorney has refused registration, the applicant may respond to the refusal to register by submitting evidence and arguments in support of registration.  If the applicant chooses to respond to the refusal to register, the applicant must also respond to the following informalities.

 

CLAIMED PRIOR REGISTRATION NOT PERTINENT

 

The applicant’s claim of ownership of U.S. Registration No. 0154545 will not be printed on any registration that may issue from this application because the registration was cancelled on January 25, 2003.

 

DISTINCTIVENESS CANNOT BE BASED ON DEAD REGISTRATION

 

A claim of acquired distinctiveness under Trademark Act Section 2(f) cannot be based on a registration that is cancelled or expired.  See In re BankAmerica Corp., 229 USPQ 852, 853 (TTAB 1986); Unitec Industries, Inc. v. Cumberland Corp., 176 USPQ 62 (TTAB 1972).  See attachment.

 

SECTION 2(f) SUGGESTED – DISTINCTIVENESS BASED ON FIVE YEARS’ USE

 

The record indicates that applicant has used its mark for a long time; therefore, the applicant may seek registration on the Principal Register under Trademark Act Section 2(f), 15 U.S.C. §1052(f), based on acquired distinctiveness.  To amend the application to Section 2(f) based on five years use, the applicant should submit the following written statement claiming acquired distinctiveness, if accurate:

 

The mark has become distinctive of the goods through the applicant’s substantially exclusive and continuous use in commerce for at least the five years immediately before the date of this statement.

 

The applicant must verify this statement with a notarized affidavit or a signed declaration under 37 C.F.R. §2.20.  37 C.F.R. §2.41(b); TMEP §1212.05(d).

 

MARK DIFFERS ON DRAWING AND SPECIMEN

 

The drawing differs from the display of the mark on the specimen.  Specifically, the marks appear in different stylizations.  The applicant must either:

 

(1)  submit a new drawing of the mark that agrees with the specimen; or

 

(2)  submit a substitute specimen that shows use of the mark shown in the drawing. 

 

37 C.F.R. §2.51; TMEP §§807.14 and 807.14(a)(i).  The applicant may not amend the drawing if the amendment would materially alter the character of the mark.  37 C.F.R. §2.72(a); TMEP §807.14(a).

 

If a substitute specimen is submitted, the applicant must verify, with an affidavit or a declaration under 37 C.F.R. §2.20, that the substitute specimen was in use in commerce at least as early as the filing date of the application.  37 C.F.R. §§2.59(a) and 2.72(a); TMEP §904.09.

 

The statement supporting use of the substitute specimen must read as follows: 

 

The substitute specimen was in use in commerce at least as early as the filing date of the application.

 

The applicant must sign this statement either in affidavit form or with a declaration under 37 C.F.R. §2.20; TMEP §904.09.
