NOTICE OF SUSPENSION
This letter responds to the applicant’s communication filed on November 3, 2004.
Applicant’s disclaimer has been entered in the record. However, the applicant’s amendment to the identification of goods in Class 7 is not acceptable for the following reason.
The wording “hedge trimmers, lawn mowers” in the identification of goods is unacceptable as indefinite. The applicant may amend this wording to “power operated hedge trimmers, lawn mowers.” TMEP §1402.01.
Action on this application is SUSPENDED pending receipt of a copy of the registration certificate from applicant’s country of origin. TMEP §§716.02(b) and 1003.04. The trademark examining attorney will issue a semi‑annual inquiry as to the status of the foreign application. TMEP §716.05.
When available, applicant should submit a copy of the foreign registration and, if the certificate is not in the English language, an English translation signed by the translator. 37 C.F.R. §2.34(a)(3)(ii); TMEP §§1004.01 and 1004.01(b).
