The assigned trademark examining attorney has reviewed the referenced application filed on October, 22, 2003, and has determined the following.

 

Search Results  Prior Pending Applications

Information is enclosed concerning pending Application Serial Nos. 76513412, 76513413, 76513414, 76513415, 76513416, 76513417, 76513418, 76513419,and 78303960.  Although the Office records have been searched and no similar registered mark has been found that would bar registration under Trademark Act Section 2(d), 15 U.S.C. §1052(d), there may be a likelihood of confusion under Section 2(d) of the Act between applicant’s mark and the marks in the above noted applications.  The filing dates of the referenced applications precede applicant’s filing date.  If one or more of these earlier-filed applications registers, registration may be refused under Section 2(d).  37 C.F.R. §2.83.

 

Identification of Services

The wording used to describe the services needs clarification because it does not describe the specific nature of the services with sufficient specificity. 

 

Applicant may adopt the following identification of services, if accurate: 

 

Financial services, namely, intellectual property-backed commercial loans and other obligations in the nature of (describe); guarantee underwriting services, namely, financial guarantee underwriting services for the purposes of credit enhancement with respect to bonds, notes or other forms of indebtedness relating to intellectual property asset backed obligations, and intellectual property-backed securitization; financial analysis and financial valuation of intellectual property.

Please note that, while the identification of services may be amended to clarify or limit the services, adding to the services or broadening the scope of the services is not permitted.  37 C.F.R. §2.71(a); TMEP §1402.06.  Therefore, applicant may not amend the identification to include services that are not within the scope of the services set forth in the present identification.
