The Section 15 Declaration of Incontestability, filed on June 29, 2015, is considered a duplicate and will not be reviewed. A Combined Affidavit was submitted previously on March 13, 2012, and accepted. However, to avoid cancellation and expiration of your registration, you must submit a newly executed Section 8 Affidavit of Use and Section 9 Renewal Application on or between March 13, 2015 and March 13, 2016, or during the grace period that ends on September 13, 2016. 15 U.S.C. §§1058(a), 1059(a); 37 C.F.R. §§2.160, 2.182. To ensure timely submission, you are encouraged to file your Section 8 Affidavit of Use and Section 9 Renewal Application via the Trademark Electronic Application System (TEAS) online at http://www.gov.uspto.report/teas/index.html.
The Section 15 Declaration of Incontestability documentation will remain in the record; i.e., it will not be returned to you and will not be processed or reviewed. See TMEP §1604.04(a). Fees submitted with the Section 15 Declaration of Incontestability will be refunded in due course and cannot be applied to any subsequent submissions.
