The petition to revive the above identified trademark application submitted on December 20, 2005 is denied pursuant to Trademark Rule 2.66. The application remains abandoned.
The petition is denied for the following reason.
Petitioner has not established due diligence in prosecuting this application. Petitioner has indicated that the notice of abandonment was not received. Therefore, to be considered timely, petitioner must establish that he or she has been duly diligent in monitoring the status of his application. To be considered diligent, a petitioner must: check the status of a pending application every six months between the filing date of the application and issuance of a registration and promptly request corrective action in writing where necessary. 37 C.F.R. §2.146(i).
Applicant may file a new application. The United States Patent and Trademark Office recommends that new applications be filed using the Trademark Electronic Application System (TEAS), available over the Internet at http://www.uspto.gov.
