The assigned trademark examining attorney has reviewed the referenced application filed on September 5, 2003, and has determined the following.

 

Search Results

The Office records have been searched and no similar registered or pending mark has been found that would bar registration under Trademark Act Section 2(d), 15 U.S.C. §1052(d).  TMEP §704.02.

 

Disclaimers

Applicant must disclaim the descriptive wording “CAMARA DIGITAL” apart from the mark as shown because it merely describes the quality and generic type of goods which are the subject matter of the identified services.  Trademark Act Section 6, 15 U.S.C. §1056; TMEP §§1213 and 1213.03(a).

 

Translation

Applicant must submit an English translation of all foreign wording in the mark.  37 C.F.R. §2.61(b); TMEP §809.  In the present case, the wording “REVELADO DE CAMARA DIGITAL” needs translating for the record. If the foreign wording has any special meaning in the foreign language, then that idiomatic meaning, if any, should also be made of record.

 

Significance of Mark

Applicant must specify whether “REVELADO DE CAMARA DIGITAL” has any significance in the photography or photo printing field or trade or industry or any geographical significance.  37 C.F.R. §2.61(b).

 

Ownership of Prior Registration

If applicant is the owner of U.S. Registration No. 2,695,018, then applicant must submit a claim of ownership.  37 C.F.R. §2.36; TMEP §812.  The following standard format is suggested:
