Response to Office Action for Post-Registration Matters

To the Commissioner for Trademarks:

The following is submitted for registration number. 2888650 UC4 :

FORM INFORMATION

 

In the Office Action, Examiner has pointed out that the Declarant is not the same as the record owner: “Office record show clear chain of title to the registration in AUTOMIC SOFTWARE GMBH (AUSTRIA LIMITED LIABILITY COMPANY). However, the party who filed the Section 8 Affidavit is identified as AUTOMIC SOFTWARE GMBH (AUSTRIA CORPORATION).” (page # 2)

It is respectfully submitted that, the literary translation of “GmbH” to English is “Limited Liability Company”.

Accordingly, we stand corrected for identifying “AUTOMIC SOFTWARE GMBH” as an “AUSTRIA CORPORATION” in our renewal filing. There is no change in the company name or ownership. We’d like to change it back to “AUSTRIA LIMITED LIABILITY COMPANY”. 

It is respectfully requested that Section 8 Affidavit be accepted and the renewal be granted.
