This filing is in response to an Office Action dated January 16, 2004 in
application Serial No. 76542934 for the PROTEGE trademark. In the Office
Action the Examiner: found the description of goods to be unacceptable as
indefinite.
AMENDMENT
Please amend the Identification and Description of Goods to the following:
International Class 9 - Computer software for initiating and monitoring the
performance of process control systems for production processes, and
monitoring the regulatory environmental compliance of those production
processes.
(previously computer software for application and event management of
advanced process control and environmental monitoring solutions)
RESPONSE
The applicant has amended its description of goods in response to the
Examiner¹s finding that the previous description was indefinite. The amended
description is in the format suggested by the examiner. The amended
description clearly states that the product is ³computer software² and
describes the function of the software and the context and/or fields in
which the software functions: process control and regulatory environmental
compliance.
Applicant believes it has responded to each and every point raised by the
Examiner and requests that the application be passed for allowance by the
Office to be published for public opposition.
