Dear Stacy,
This correspondence is responsive to the Office Action, dated June 1, 2004,
on the above referenced trademark and serves as the request of The Scoular
Company ("Applicant") for an amendment of the application filed on the above
trademark as follows:
Drawing-Specimen Agreement
The relevant Office Action noted that the drawing and the substitute
specimen that was submitted on April 21, 2004, do not agree and instructed
the Applicant to submit a new drawing that agrees with the substitute
specimen or to submit a substitute specimen that agrees with the drawing.
Applicant desires to amend the drawing of the mark to one that agrees with
the substitute specimen by deletion of the words THE and COMPANY from the
drawing. Accordingly, attached hereto is Applicant's amended drawing of the
mark.
Withdrawal of Disclaimer
Applicant desires to withdraw the following disclaimer in its application:
"No claim is made to the exclusive right to use COMPANY apart from the mark
as shown."
Having addressed all of the issues raised in the First Office Action on the
above referenced matter, The Scoular Company respectfully requests
consideration by the Examiner of priority registration of the trademark.
